1. Agreement to these terms
By accessing or using Smart School Choice (“the Service”, “we”, “us”), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.
We may update these terms from time to time. Continued use of the Service after changes are published constitutes acceptance of the updated terms.
2. About the Service
Smart School Choice is an information platform that aggregates publicly available school data to help Australian families research and compare schools. School data is sourced from the Australian Curriculum, Assessment and Reporting Authority (ACARA) My School dataset and may be supplemented by information provided directly by school administrators.
The Service is free for parents and carers to use. School listing enhancements are available to school administrators on a paid subscription basis (see Section 6).
3. Accuracy of information
We take reasonable steps to ensure the accuracy of data presented on the Service. However:
- ACARA data is updated annually and may not reflect the most recent figures
- School-provided content (descriptions, photos, fees, open days) is the responsibility of the school
- NAPLAN scores, ICSEA values, and enrolment figures are presented as published by ACARA
Smart School Choice makes no warranty, express or implied, as to the accuracy, completeness, or fitness for a particular purpose of any information on the Service. You should independently verify any information before making enrolment decisions.
4. Limitation of liability
To the maximum extent permitted by Australian law, Smart School Choice is not liable for any direct, indirect, incidental, or consequential loss or damage arising from your use of the Service or reliance on information provided on the Service.
Nothing in these terms limits any rights you have under the Australian Consumer Law that cannot lawfully be excluded.
5. Acceptable use
You must not use the Service to:
- Scrape, harvest, or systematically extract data without our written permission
- Submit false or misleading enquiries to schools
- Interfere with the operation of the Service or its infrastructure
- Circumvent or attempt to circumvent any security or access controls
- Use the Service for any unlawful purpose
We reserve the right to terminate or restrict access to the Service for any user who breaches these terms without notice.
6. School listings
Schools that purchase Enhanced or Premium listings (“Subscribers”) agree to the following additional terms:
6.1 Content responsibility
Subscribers are responsible for all content they upload or publish via the admin portal, including descriptions, photos, videos, fee information, and open day details. Content must be accurate, not misleading, and must not infringe any third-party rights.
6.2 Content standards
We reserve the right to remove or decline to publish content that we determine, in our sole discretion, to be misleading, offensive, or in breach of these terms.
6.3 Billing and cancellation
Pricing for Enhanced and Premium listings is provided at the time of engagement. Smart School Choice Pty Ltd reserves the right to update pricing with reasonable notice to affected schools. Cancellation terms are provided at the time of sign-up.
6.4 ACARA data integrity
Subscribers acknowledge that NAPLAN scores, ICSEA values, and enrolment data are sourced from ACARA and cannot be edited via the admin portal. This protects the integrity of the data for parents and is a non-negotiable aspect of the Service.
7. Parent enquiries
When a parent submits an enquiry to a school via the Service, Smart School Choice acts as an intermediary to forward that enquiry. We do not guarantee that schools will respond to enquiries, and we are not responsible for the content of any school's response.
8. Intellectual property
The Smart School Choice name, logo, website design, and original content are our intellectual property. School logos, photos, and descriptions uploaded by school administrators remain the property of the relevant school.
ACARA data is used in accordance with ACARA's open data licence. Attribution is provided on school profile pages.
9. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these terms by reference.
10. Governing law
These terms are governed by the laws of Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Victoria.
